Terms of Service

These terms govern your use of JOM, operated by Jom IT Technologies Sdn. Bhd. ("JOM", "we", "us"). By signing in or using the service, you agree to these terms.

If your employer signed a separate Master Services Agreement (MSA) with us, that agreement governs the relationship between JOM and your employer, and prevails over these terms where they conflict.

You must be at least 16 years old to use JOM. You are responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us at support@get-jom.com if you suspect unauthorised access.

You agree not to:

• Use JOM to break the law, infringe rights, or harass anyone
• Upload malware, scrape the service, or attempt to bypass security controls
• Reverse-engineer, resell, or rebrand JOM without written permission
• Use the service to make automated decisions that have legal or similarly significant effects on individuals — JOM's AI outputs are decision support, not decisions
• Submit personal data about anyone you do not have a lawful basis to process

You own your data. Content you or your organisation uploads (employee profiles, CVs, assessment responses) remains yours. You grant us a limited licence to host, process, and display it for the purpose of delivering the service.

We own the platform. JOM's software, models, designs, and documentation are our intellectual property. We grant you a non-exclusive, non-transferable right to use the service while these terms are in effect.

JOM uses large language models (currently Google Gemini via Vertex AI) to generate assessments, competency maps, and interview suggestions. These outputs:

• Are decision support, not final decisions, and may contain inaccuracies or bias
• Should always be reviewed by a qualified human before influencing hiring, promotion, or other employment decisions
• Are generated from the data you provide — garbage in, garbage out applies

You are responsible for how you use these outputs and for ensuring your downstream decisions are fair, lawful, and well-justified.

We work hard to keep JOM available and reliable, but the service is provided "as-is" without uptime guarantees unless your organisation has signed an MSA with a separate SLA. We may perform maintenance, update features, or temporarily suspend access without notice where reasonably necessary.

To the maximum extent permitted by law, JOM is not liable for indirect, consequential, incidental, or punitive damages, lost profits, or lost data arising from your use of the service. Our total liability for any claim is capped at the greater of (a) the amount you or your organisation paid JOM in the 12 months before the claim, or (b) MYR 100.

Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot be limited under Malaysian law.

You may stop using JOM at any time. We may suspend or terminate accounts that violate these terms or pose security risks. On termination, your access ends and your data is handled per our retention rules in the privacy policy.

We may update these terms as our business and the law evolve. Material changes will be notified by email or an in-product banner at least 14 days before they take effect. Continued use after that date means you accept the new terms.
